Welcome to GoMyTruck! By accessing or using our mobile applications, websites, or services (collectively, the "Platform"), you agree to be bound by these Terms & Conditions. If you do not agree to these Terms, you may not use the Platform.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and GoMyTruck (the "Company"). This agreement governs your access to and use of our logistics, transport, and workforce matching services.

2. Eligibility

To use the Platform, you must:

  • Be at least 18 years of age.
  • Possess the legal authority to enter into a binding agreement under the Indian Contract Act, 1872.
  • For Drivers and Workforce Partners: Maintain valid identification, licenses, and background checks as mandated by the Company and local authorities.

3. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your OTPs and account credentials.
  • All activities that occur under your account.
  • Ensuring that all information you provide (such as Aadhaar, PAN, and RC) is accurate, current, and complete.

The Company reserves the right to suspend or terminate your account if any information provided proves to be false, inaccurate, or incomplete.

4. Platform Services

GoMyTruck operates as a technology platform that connects users seeking logistics or labor services ("Customers") with independent third-party providers ("Drivers", "Fleet Owners", and "Workforce Partners").

Disclaimer: GoMyTruck does not provide transportation or labor services directly. We are solely a technology intermediary. The independent contractors who provide the physical services are solely responsible for their performance.

5. Fraud Prevention & Identity Verification

To maintain the safety and integrity of the Platform:

  • We require identity verification via Aadhaar, PAN, and facial recognition for all Partners.
  • Attempting to bypass the GPS location tracking, faking proof of delivery, or sharing your partner account with unauthorized individuals is strictly prohibited.
  • Any fraudulent activity will result in immediate termination of your account, forfeiture of your wallet balance, and potential legal action.

6. Earnings, Wallet, and Payouts (For Partners)

If you are a Driver or Workforce Partner:

  • Earnings: Fares and wages are calculated dynamically based on distance, labor required, time, and market demand.
  • Commission: GoMyTruck deducts a service fee/commission from gross earnings before depositing the net amount into your in-app Wallet.
  • Payouts: Wallet balances can be withdrawn to your verified bank account subject to our standard processing times and RazorpayX gateway availability.
  • Taxes: You are an independent contractor. You are solely responsible for declaring and paying your own income tax. Where applicable, GoMyTruck may deduct TDS as per the Income Tax Act, 1961.

7. Customer Behaviour

Customers using the platform agree to:

  • Not use the service to transport illegal, hazardous, or stolen goods.
  • Treat all Drivers and Workforce Partners with respect.
  • Ensure that the pick-up and drop-off locations are safe and accessible.
  • Pay all charges, tolls, and wait-time fees incurred during the booking.

8. Intellectual Property

All intellectual property rights in the Platform, including software, design, logos, and trademarks, are owned by GoMyTruck. You are granted a limited, non-exclusive, non-transferable license to use the Platform for its intended purpose.

9. Liability & Indemnification

Limitation of Liability: To the maximum extent permitted by law, GoMyTruck shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, lost data, or personal injury arising out of your use of the Platform.

Indemnification: You agree to indemnify and hold harmless GoMyTruck, its directors, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or your use of the Platform.

10. Suspension and Termination

We reserve the right to suspend or terminate your access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is harmful to our business interests.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Kolkata, India.
