This Independent Partner Agreement (the "Agreement") is a legally binding contract between GoMyTruck ("Company", "We", "Us") and you ("Partner", "Driver", "Workforce Member", "You").

By registering as a Service Partner on the GoMyTruck Driver App or GoMyTruck Workforce App, you agree to the terms below. If you do not agree, you may not provide services on the GoMyTruck platform.

1. Independent Contractor Relationship

No Employment: You acknowledge and agree that your relationship with GoMyTruck is strictly that of an independent contractor. This Agreement does not create an employment, agency, partnership, or joint venture relationship.

You are not entitled to employee benefits, including but not limited to health insurance, provident fund (PF), gratuity, or paid leave.
You have the absolute right to decide when, where, and for how long you wish to use the GoMyTruck platform. You are never obligated to accept any specific job.

2. Partner Responsibilities

When you accept a booking through the platform, you agree to:

Professionalism: Perform the requested services (driving, loading, unloading, or warehousing) professionally, safely, and in accordance with all applicable laws.
Safety: Maintain a safe environment. Drivers must ensure their vehicles are roadworthy and fully insured. Workforce partners must adhere to standard safety protocols while lifting and loading cargo.
Uniform & Equipment: While operating on behalf of the platform, you are encouraged to wear any provided GoMyTruck uniform/apparel to build trust with customers, though you remain responsible for your own tools and equipment.
Documents: Keep all required documents (Aadhaar, PAN, DL, RC) valid and up to date. You must notify us immediately if any license or certification is suspended.

3. Financial Terms

A. Payouts and Earnings

Your earnings for each job are determined by the GoMyTruck dynamic pricing engine, taking into account distance, labor required, time, and current market demand. The estimated payout is shown to you before you accept a job.

B. Commissions

GoMyTruck charges a service fee (commission) for facilitating the connection between you and the customer. The exact commission percentage is displayed in your Earnings Dashboard and is deducted from the gross fare.

C. Wallet & Withdrawals

Your net earnings are credited to your in-app GoMyTruck Wallet.
You may withdraw your Wallet balance to your verified bank account at any time.
GoMyTruck is not responsible for delays caused by banking networks, UPI downtimes, or incorrect bank details provided by you.

D. Taxes

As an independent contractor, you are solely responsible for calculating, reporting, and paying your own income taxes. Depending on Indian tax laws, GoMyTruck may be required to deduct Tax Deducted at Source (TDS) and GST, which will be visible in your earnings breakdown.

4. Incentives and Subsidies

GoMyTruck may occasionally offer Minimum Payout Guarantees (MPP), promotional incentives, or distance subsidies.

These offers are fully at the discretion of the Company.
The Company reserves the right to withhold incentive payouts if our systems detect fraudulent behaviour, collusion with customers, or artificial manipulation of trip metrics.

5. Termination

By You: You may terminate this Agreement at any time by ceasing to use the Platform and requesting account deletion. By GoMyTruck: We may terminate or suspend this Agreement and your access to the Platform immediately if you:

Violate any terms of this Agreement or the Community Guidelines.
Maintain an excessively low customer rating.
Engage in fraud, theft, or any illegal activity.
Fail a background check.

6. Liability

You agree to bear all liability arising from the physical performance of your services. GoMyTruck provides the technology to match you with customers but is not responsible for any property damage, personal injury, or traffic violations that occur during a booking.

By accepting these terms in the app, you acknowledge that you have read, understood, and agreed to this Independent Partner Agreement.
